Revised Terms and Conditions for Property Hustlers: Effective as of January 17, 2024.

Welcome to Property Hustlers and/or its affiliates ("Elite Real Estate Network"). These terms and conditions govern your use of www.propertyhustlers.ca and its associated services, collectively referred to as "Property Hustlers Exclusive Coaching Program" By accessing or utilizing Property Hustlers Services, you agree to comply with the following terms and conditions.

Agreement Acceptance:

Property Hustlers offers various services catering to both content providers and consumers. These Terms and Conditions are applicable to both parties, with specific Service Terms taking precedence where inconsistencies arise. Please carefully read and understand these Terms before accessing or using Property Hustlers Services. Your use of the platform indicates your acceptance of these terms, forming a binding agreement between you, your business, and Property Hustlers.

Important Notice:

These Terms include disclaimers, limitations of liability, and provisions for mandatory binding arbitration and class action waiver, relinquishing your right to a court hearing or jury trial. Your continued use of Property Hustlers Services constitutes acceptance of any changes made to these Terms, and it is your responsibility to check for updates.

SECTION 1 – Website Use:

Property Huslers Website is intended for adult-operated businesses. By using the Website, you affirm that you are at least 18 years old (or the legal age of majority in your state or province), operate a business, can enter a binding contract, and have read and agreed to these Terms.

SECTION 2 – Website User Conduct and Restrictions-License Terms:

All elements of our Website are protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Website, subject to strict compliance with these Terms. This includes refraining from harmful acts, spamming, offensive communications, and the unauthorized use of Property Hustlers intellectual property.

SECTION 3 – Our Privacy Statement and Your Personal Information:

Your submission of personal information is governed by our Privacy Statement, which may be viewed on our website. Property Hustlers reserves the right to modify the Privacy Statement.

SECTION 4 – Information You Provide; Registration; Passwords:

As a Property Hustler user, you agree to provide truthful and accurate information during account creation. You are responsible for maintaining password confidentiality and ensuring no unauthorized access to your account.

SECTION 5 – Refund Policy

All payments by STUDENT to Exclusive Coaching Program are non-refundable and final. STUDENT further agrees to waive any right to “charge-back” or dispute payment with his/her credit card processor or bank. STUDENT further acknowledges that there is no refund whatsoever if ELITE COACHING terminates STUDENT’s participation in the Exclusive Coaching Program for cause during the term of this Coaching Agreement.

SECTION 6 – Products, Services, and Prices

Products, services, and prices posted on www.propertyhustlers.ca are subject to change without notice. Property Hustlers may discontinue or modify products, services, or prices at its discretion. Product or service descriptions may not be error-free, and Property Hustlers is not liable for discrepancies.

SECTION 7 – Individual Results Disclaimer

Individual results vary in online businesses due to unique factors. Property Hustlers does not guarantee success, income, or sales. Users are responsible for business success, and Property Hustlers does not provide leads. No earnings or effort claims are made, and no specific monetary outcome is assured. Users should expect that results will require time and effort.

SECTION 8 – Business Responsibilities

Users affirm they operate a lawful business and are solely responsible for compliance with laws governing their business activities. Users must notify Property Hustlers of any legal issues, and indemnify Property Hustlers for any law violations. Users are responsible for tax obligations related to their business and agree to indemnify Property Hustlers for claims arising from law violations.

SECTION 9 – Testimonials, Reviews, and Content Submission

Property Hustlers may use user testimonials and reviews, along with submitted content, at its discretion. Users grant Property Hustlers a license to use submitted content. Property Hustlers reserves the right to edit or remove content and is not liable for user-generated content.

SECTION 10 – Compliance with Laws, Including Commitment Against Harassment and Interference with Others ("Targeting")

As a user of Property Hustlers, adherence to all applicable laws, both domestic and international, is imperative. This includes, but is not limited to, regulations governing deceptive advertising, marketing, email marketing (such as the CAN-SPAM Act), telemarketing (as per the Telephone Consumer Protection Act and Federal Trade Commission’s Telemarketing Sales Rule), intellectual property, privacy, security, terrorism, corruption, child protection, and import/export laws. You are personally responsible for ensuring compliance with all relevant laws, rules, regulations, and court orders in any jurisdiction applicable to you, your business, and any recipients of digital messages sent through Property Hustlers products or services. Additionally, you must comply with applicable laws when using messaging software or hardware, agreeing to indemnify and defend Property Hustlers against any claims arising from your use or misuse of such tools.

COMMITMENT AGAINST TARGETING AND HARASSMENT AND INTERFERENCE WITH OTHERS.

Property Hustlers users must refrain from using the services, either independently or in conjunction with other software or hardware, to store, distribute, or transmit malicious content. This includes material known or reasonably believed to be tortious, libelous, offensive, infringing, harassing, harmful, disruptive, or abusive. Users are also prohibited from engaging in, promoting, aiding, or abetting any behavior that is or may be tortious, libelous, offensive, infringing, harassing, harmful, disruptive, or abusive.

SECTION 11 – Disclaimers of Other Warranties

The website and its content are provided "as is," "as available," without any warranties, whether express or implied, including but not limited to warranties of title, merchantability, or fitness for a particular purpose. Property Hustlers disclaims any representations and warranties concerning the reliability, timeliness, quality, suitability, availability, accuracy, and/or completeness of the information on the website. Additionally, Property Hustlers does not guarantee the security, timeliness, uninterrupted or error-free operation of the website, software, or services.

SECTION 12 – Limitations of Liabilities

Property Hustlers, its officers, directors, shareholders, employees, independent contractors, telecommunications providers, and agents are not liable for any indirect, special, incidental, exemplary, consequential, or punitive damages, fees, costs, or claims arising from or related to the agreement, privacy statement, services, products, or the use of the website, software, or services. This includes, but is not limited to, loss of use, profits, data, goodwill, and costs of substitute services or products, regardless of whether Property Hustlers was aware of the possibility of such damages.

SECTION 13 – Dispute Resolution by Mandatory Binding Arbitration and Class Action Waiver

Disputes between users and Property Hustlers must be resolved through confidential arbitration, waiving the right to a trial by jury. Claims must be brought on an individual basis, and the arbitrator's authority is exclusive in resolving disputes related to the interpretation, validity, or enforceability of the agreement. Users and Property Hustlers agree to waive any right to pursue class or representative actions against each other.

SECTION 14– Property Hustlers Additional Remedies

In case of a breach or threatened breach of the agreement, or infringement of Property Hustlers intellectual property, the company is entitled to seek injunctive relief in court. This does not preclude Property Hustlers from pursuing other remedies available, including monetary damages.

SECTION 15 – Indemnification

Users agree to defend, indemnify, and hold harmless Property Hustlers from any claims, actions, losses, liabilities, damages, expenses, demands, and costs arising from the use or misuse of the website, software, products, or services, including breaches of the agreement, privacy statement, or any applicable laws.

SECTION 16 – Notice and Takedown Procedures; Digital Millennium Copyright Act

Procedures for addressing copyright infringement are outlined, allowing users to request the removal of infringing materials. The Digital Millennium Copyright Act is incorporated by reference.

SECTION 17 – THIRD-PARTY LINKS

Property Hustlers is not responsible for the content or functionality of external websites linked on the platform. The views expressed in external content are those of the authors or contributors and not necessarily endorsed by Property Hustlers

SECTION 18 – Termination

The agreement becomes effective upon specific user actions and may be terminated by Property Hustlers if a user fails to comply with the terms. Certain sections survive termination, and users remain responsible for outstanding payments.

SECTION 19 – No Waiver

Property Hustlers failure to exercise a right or remedy does not constitute a waiver, and a waiver is effective only if in writing and signed by Property Hustlers.

SECTION 20 – Force Majeure

Property Hustlers is not liable for delays, damages, or failures caused by acts of nature or other factors beyond its control.

SECTION 21 – Assignment

Property Hustlers can assign its rights under the agreement without notice, but user rights cannot be assigned without Property Hustlers written consent.

SECTION 22 – Electronic Signature

Electronic communication is accepted, and users agree to electronic communication equivalent to written communication.

SECTION 23 – Changes To The Agreement

Property Hustlers reserves the right to update, change, or replace any part of the agreement. Continued use of the website after changes constitutes acceptance.

SECTION 24 – Your Additional Representations and Warranties

Users represent that they are of legal age, have the right to bind their business, have read and understood the agreement, and will not resell, redistribute, or export products or services ordered from the website. Users also represent that there are no government investigations, inquiries, or lawsuits against them. Users must notify Property Hustlers of any such actions, with Property Hustlers having the discretion to terminate the agreement.

SECTION 25 – Severability

Should any provision of this Agreement be deemed invalid or unenforceable by the arbitrator or a court of competent jurisdiction, the unaffected provisions shall remain in full force and effect. The invalidated provision may be adjusted or removed to the extent necessary for enforcement while maintaining consistency with the rest of the Agreement.

SECTION 26 – Entire Agreement

These Terms, the Agreement, and any policies or rules posted on the Website constitute the comprehensive understanding and agreement between you, your business, and Property Hustlers. They govern your website access, use, ordering, purchasing, and product or service utilization, supplanting any prior or contemporaneous agreements, whether oral or written. Any potential future services or features introduced on the Website will also be subject to these Terms, the Agreement, and associated policies or rules. Ambiguities in interpreting these Terms or the Agreement shall not be construed against the party responsible for drafting.

Note on Communication Preferences:

By accepting our terms of service, a prospect agrees to receive various forms of communication from Property Hustlers, including snail mail, email, phone calls, and automated prerecorded voice messages. This communication may come from Property Hustlers, its business divisions, affiliates, partners, vendors, list managers, and clients who purchase their lists. Consent is granted for recurring contact as long as the prospect is part of the sms/mms mobile message marketing program.

Personal information supplied to Property Hustlers may be sold, and collaboration with third-party businesses may occur to present retail opportunities via direct mail, email, SMS, text, and telemarketing, including pre-recorded phone messages. Filling out forms on Property Hustlers pages constitutes an agreement to be contacted through various communication channels.

Prospects understand that they may be contacted even if their number is listed on a state or federal do-not-call list. By submitting forms, prospects agree that they cannot build a case against Property Hustlers for alleged infractions. Both parties are not liable for special, indirect, incidental, or consequential damages.

Message and data rates may apply, and prospects are solely responsible for any third-party fees incurred during contact by Property Hustlers and its associates.

In case of disagreement with the terms and conditions, prospects are advised not to digitally sign the agreement by submitting forms on Property Hustlers websites.

To unsubscribe from communication mediums, prospects can send an email to [email protected], indicating the phone number or email address to be removed.
